Ministry of Corporate Affairs Recruitment 2023: The Ministry of Corporate Affairs (MoCA), Government of India has invited Online Applications from Experienced Personnel for  02 Posts Judicial Members and Technical Members for Selection in the National Company Law Tribunal vide the Ministry of Corporate Affairs Recruitment 2023 Official Vacancy Circular Dated 06.06.2023. The Ministry of Corporate Affairs Recruitment 2023 Official Vacancy Circular has arisen for  Junior Member and Technical Members with 10 (05 + 05) Vacancies to be filled up for Posting in New Delhi or Chennai or other Benches, if any, to be established in the future at other places Countrywide.

Based on the Ministry of Corporate Affairs Recruitment 2023 Official Vacancy Circular, the Closing Dates for receipt of Online Applications and duly completed Applications in the shape of Hard Copies from the Personnel through Proper Channel are 19.07.2023 and 31.07.2023 respectively. Appointment Terms: Initially 05 Years and Re-appointment for further 05 Years, till attaining 65 Years

Monthly Pay: Level 15 (Rs.182200-224100)

Office Tenure:  Every Member Appointed as the Judicial Members and Technical Members shall hold the Office and continue Initially for 05-Years’ Term with a Further Extension of 05 Years until 65 Years attained.

Eligibility for Ministry of Corporate Affairs Recruitment 2023:

The Eligibility for Ministry of Corporate Affairs Recruitment 2023 Official Vacancy Circular for Judicial and Technical Members should have gained the Eligibility Criteria explained hereunder:

Educational and Professional Qualifications and Other Terms and Conditions: The Qualifications, Eligibility, Salary and other Terms and Conditions of the Appointment of any Candidate will be governed by the Provisions of the Tribunals Reforms Act 2021 and the Tribunal (Conditions of Service) Rules 2021. The Main Terms and Conditions are following:

01: Judicial Member Post:

a) is or has been, a Judge of any High Court; Or

b) is a Judicial Member of the National Company Law Tribunal for 05 Years; Or

c) has been an Advocate for 10 Years with Substantial Experience in Litigation in matters relating to Company Affairs before the National Company Law Tribunal, National Company Law Appellate Tribunal, High Court, Or Supreme Court.

02: Technical Member Post:

Any Person of Proven Ability, Integrity, and Standing having Special Knowledge and Professional Experience of Minimum 25 Years in Law, Industrial Finance, Industrial Management Or Administration, Industrial Reconstruction, Investment, Accountancy or any other matter, which is useful to the National Company Law Appellate Tribunal.

The Selection Process for Both Judicial Member and Technical Member Positions under Ministry of Corporate Affairs Recruitment 2023 Official Employment Notice:

Selection Procedure:  The Search-Cum-Section Committee constituted under the Tribunal Reforms Act 2021 for recommending the names for Appointment to the Notified Post(S) shall conduct a Scrutiny of the Applications with respect to  Suitability of Application for the Posts by giving due Weightage to the Qualifications and Experience of the Candidates and shortlisting Eligible Candidates for conducting Personal Interaction.

Final Selection for the Post(s) will be carried through based on the Overall Evaluation of Candidates done by the Committee based on Qualification, Experience, and Personal Interaction.

Terms of Appointment: The Member(s) will draw Pay/Salary in the Pay Matrix Level 14 of the 7th Central Pay Commission Plus Allowances as admissible. Pay Protection is available for the Applicants, serving or retired (Government Officer/Chairman, Vice Chairman, President, Vice-President, Presiding Officer, Member of the Tribunal, Appellate Tribunal or any Authority, or a Judge of the High Court), who are/were in Higher Pay Scale, including Apex Scale under the Government of India. The Pay Scale and other Service Conditions would be governed by the National Company Law Tribunal (Salaries and Allowances and other Terms & Conditions of Service of the President and other Members) Rules 2015.

Any Officer selected, if already in the Government Service, may retain his/her lien with his/her Parent Cadre or Ministry or Department, as the case may be while holding the Office as such for a Period Not Exceeding 01 (One) Year.
