9 Days Insufficient to Respond to 150-Page Report: High Court Remands Matter to AO
The Gujarat High Court quashed an order as the Income Tax Department did not give enough time to reply to the Reports, running into more than 150 pages.
The Income Tax Department issued a notice to the petitioner Company, Star Rays, seeking further details, for which the company requested time till 16.06.2025. The Tax Officer gave extended time till 23.06.2025 to submit the reply and gave all the details and reports to the petitioner on 20.06.2025. The reports were lengthy, running into more than 150 pages. However, the final order was passed on 29.06.2025, giving only nine days to examine the document and reply to it.
The petitioner requested the Gujarat High Court to grant enough time to the petitioner to reply to the final notice under section 148 of the Income Tax Act issued on 29.06.2025.
The High Court said that nine days were too short, especially when the case involved transactions and various parties. It agreed with the contentions of the petitioner that the said order was passed without giving effective time to the petitioner to deal with the reports.
As a result, the court set aside the order and remanded the matter to the Assessing Officer to pass a fresh order within 12 weeks.
