Sales Tax Bar Association raised issue of Malpractices in Central Registration Cell Branch of Delhi GST Department
The Sales Tax Bar Association (STBA) has raised the issue of malpractices in the Central Registration Cell Branch of the Delhi GST Department and filed a complaint on this issue with the Additional Commissioner-I of Delhi Goods and Services Tax.
The Relevant Text read as follows:
It has come to our attention that the officers at the CRC Branch are not performing their duties in accordance with the provisions of the GST Act and the rules made thereunder.
The concerned officers at the CRC, DGST Department, New Delhi, have issued Show Cause Notices (SCNs) asking for unnecessary documents that were already submitted at the time of applying for registration, as per the checklist provided with the Registration Application Form (GST REG-01) or not required as per the provisions of the GST Act and Rules thereunder. This behaviour reflects a malicious intent on the part of the officers.
The office bearers of STBA have met with the officers on several occasions to raise these grievances, but unfortunately, no corrective action has been taken. The officers’ actions appear to be arbitrary and contrary to the law. It is important to recognise that the government can only generate revenue once a person is registered, and these unjustified denials of registration are not only harming the applicants but also preventing the government from collecting rightful revenue.
Furthermore, we have obtained evidence that the CRC Branch is granting registrations to unauthorised individuals despite the lack of appropriate documentation and that these registrations are being completed in a very short amount of time.
This points to widespread wrongdoing inside the CRC Branch of the Delhi GST Department, necessitating prompt attention and corrective action.
In light of the above, we respectfully request that you look into this matter and initiate a departmental enquiry against the concerned officers. It is imperative to address and eliminate the malpractice within the department.
