High Court Refuses Relief; Fraud Allegations in Partnership Dispute Proceed

The petitioner approached the High Court seeking the quashing of criminal proceedings arising from a police case registered under the Bharatiya Nyaya Sanhita, 2023. The dispute stemmed from a partnership business formed in April 2021. According to the complainant, the petitioner induced him into the partnership by presenting himself as a credible businessman but failed to invest the promised capital. It was alleged that the petitioner was entrusted with financial control and business records, which he later misused.

Discrepancies were found in accounts, including alleged forged entries, manipulation of records, and misappropriation of funds exceeding Rs. 16 lakh. He was also accused of making unauthorised withdrawals and withholding key documents. The petitioner argued that the matter was purely civil in nature, arising out of partnership dealings. However, the State maintained that the allegations pointed to fraud and breach of trust.

Main Issue: Whether criminal proceedings in a partnership dispute can be quashed at the threshold on the ground that the dispute is civil in nature.

HC Held: The High Court refused to quash the proceedings, holding that at this stage, the allegations must be taken at face value. It found that the complaint contained specific allegations of inducement, failure to invest capital, and diversion of funds, which prima facie disclosed offences of cheating and criminal breach of trust.

The Court rejected the argument that the dispute was purely civil, observing that criminal proceedings are maintainable where dishonest intent is alleged from the beginning. Finding no ground for interference, the Court allowed the investigation to continue in accordance with the law.
