ITAT Deletes Rs 1.80 Crore Addition, Holds Asset Revaluation Does Not Mean Fresh Investment:

The ITAT upheld the deletion of a Rs 1.80 crore addition under Section 68, holding that the increase in asset value arose from revaluation of assets acquired in an earlier financial year rather than any fresh unexplained investment.
ITAT Finds No Basis for Rs 1.80 Crore Addition After Asset Revaluation

The ITAT Ahmedabad Bench has dismissed the Revenue’s appeal and upheld the deletion of an addition of Rs 1.80 crore made against Magaram Kumbharam Jat for Assessment Year 2017-18 on account of an alleged unexplained increase in capital.
During the assessment proceedings for the AY 2017-18, the Assessing Officer (AO) had issued a show cause notice (SCN) to Magaram Kumbharam Jat (assessee), asking him to show cause the source of the increase/investment in the capital.
In response to the notice, the assessee explained that he is the owner of a company named M/s. M K Enterprise. Further stated that "the increase in the capital account was on account of introduction of capital in the form of addition to fixed assets i.e. land, building and machinery in his proprietary business and the source of the investment was the business receipts / realisation from debtors."
He further claimed that he had acquired the fixed assets during the financial year 2015-16 (assessment year 2016-17). All the payments were made using banking channels, and no purchase of assets was made during the assessment year under consideration.
He submitted that the actual cost of the assets was Rs 1.32 crore, which was subsequently increased to Rs 1.80 crore after revaluation at market rates. The assessee clarified that no new assets were purchased and no fresh capital was introduced during the relevant assessment year. The investments were funded through business receipts and realisation from debtors, with payments made through banking channels.
The Assessing Officer (AO) did not dispute the source of funds but pointed out discrepancies between the accounts of the proprietorship business and the assessee’s individual balance sheet. Considering the unexplained increase in asset value, the AO added Rs. 1.80 crore under Section 68 of the Income Tax Act, 1961.
On appeal, the Commissioner of Income Tax (Appeals) [CIT(A)] deleted the addition, observing that the assets had been purchased in an earlier assessment year and that the increase in value resulted from revaluation rather than any fresh investment from unexplained sources.
The Income Tax Appellate Tribunal (ITAT) observed that the assessee had submitted bank entries, purchase bills, payment records and sale deeds to support the transactions. Since the assets were acquired in the earlier financial year and the source of investment was explained, the Tribunal found no justification for the addition. Accordingly, it upheld the CIT(A)’s order and dismissed the Revenue’s appeal.
