The Government of Maharashtra under the Department of Revenue has issued Circular No. 2026/Pr.Kr. 367/Mudrank-2, dated October 12, 2026, regarding the non-registration of documents for unauthorised/illegal constructions.

Based on a meeting held on September 22, 2026, under the chairmanship of the Honourable Revenue Minister, some instances were observed where flats were being sold in multiple parts of the state by setting up construction projects without taking proper permission from the competent authority. Additionally, flats of a larger area were being sold than the area permitted in the sanctioned plans. These practices were causing financial fraud to the concerned flatholders.

Consequently, to curb such malpractices and illegal property sales and protect home buyers, the government is planning to instruct the sub-registrar of the state not to register the documents of transfer of flats constructed without permission or flats of more than the sanctioned area.

The following are the instructions that are being issued to all the officers who are registered through the Sub-Registrar in the State:

The Sub-Registrar in a state is now not allowed to register the documents, including the agreement for first sale, deed of purchase or deed of apartment, and transfer deed of flats in any construction project:
