The Department of Revenue, following the issuance of instructions by the Chief Minister, Devendra Fadnavis, has issued a key government circular dated October 19, 2026, in order to clarify rules for the registration process for the sale of shares in 7/12 land with joint ownership.

The circular is aimed at simplifying the registration process, reducing disputes among co-owners, and minimising unnecessary court cases. As per the guidelines issued vide the circular, a co-owner who wants to sell their share in jointly owned land will no longer be required to obtain the written consent or a No Objection Certificate (NOC) from the other co-owners if they attach the relevant ‘KA’ copy of the measurement record obtained from the Land Records Department to the registration document.

However, on the other hand, if the 'KA' copy is not obtained or attached, the Sub-Registrar cannot register the sale document without the written consent or NOC of the other co-owners whose names appear in the common 7/12 land record. Consequently, in this situation, obtaining the consent of the other co-owners becomes obligatory for registration.

The circular has also highlighted the provisions of Section 44 of the Transfer of Property Act, 1882, which authorises a co-owner to transfer his/her undivided share in jointly owned property without the consent of the other co-owners. However, obtaining measurement records and following the prescribed registration procedure can further contribute to avoiding disputes regarding the share being sold. The government understands that obtaining written consent from every co-owner can be a difficult task, especially when a property is owned by more than one individual.

Another key objective of this circular is to balance the legal rights of co-owners with the practical requirements of property registration. The government expects the clarified procedure to reduce complaints against registration offices, prevent unnecessary legal actions, and bring greater transparency to transactions involving jointly owned land.
