MCA Notifies Companies (Registration of Charges) Amendment Rules, 2022

The Ministry of Corporates Affairs (MCA) vide Notification No. F. No. 01/10/2013 CL-V dated 27th April 2022 notifies Companies (Registration of Charges) Amendment Rules, 2022.

The Notification is Given Below:

G.S.R. 320(E).—In exercise of the powers conferred by section 77 read with sub-sections (1) and (2) of section 469 of the Companies Act, 2013 (18 of 2013), the Central Government hereby makes the following rules further to amend the Companies (Registration of Charges) Rules, 2014, namely:—

1. Short title and Commencement. – (1) These rules may be called the Companies (Registration of Charges) Amendment Rules, 2022.

(2) They shall come into force from the date of their publication in the Official Gazette.

2. In the Companies (Registration of Charges) Rules, 2014, in rule 3, after sub-rule (4), the following sub-rule shall be inserted, namely:-

“(5) Nothing contained in this rule shall apply to any charge required to be created or modified by a banking company under section 77 in favour of the Reserve Bank of India when any loan or advance has been made to it under sub-clause (d) of clause (4) of section 17 of the Reserve Bank of India Act, 1934 (2 of 1934).”.
