RD Confirms Penalty of Rs. 2.21 Lakh for Holding More Than One DIN
The Registrar of Companies (ROC), West Bengal, has imposed a penalty of Rs. 2,21,500 on a Director named Krishna Agarwal for violating Section 155 of the Companies Act, 2013.
The Director Identification Number (DIN) is a unique identification number issued to individuals who are directors of companies or aspiring to be directors of a company. Section 155 of the Act prohibits any individual from obtaining or possessing more than one Director Identification Number (DIN).
The director had obtained a duplicate DIN, which he used for 343 days (From April 13, 2023, to March 21, 2024). The ROC has penalised the director as per the following table:
The Director was ordered to pay the mentioned amount of penalty within 90 days. If he fails to do this, legal actions will be taken against him under Section 454(ii) of the Companies Act, 2013, which defines the additional penalty for the defaulting person who has failed to pay the penalty within 90 days.
The Director filed an appeal with RD, but RD went ahead and confirmed penalty by ROC.
