The Ministry of Corporate Affairs (MCA) has issued an adjudication order against a company named Prateek Realtors India Pvt Ltd for violating Section 12(1) of the Companies Act, 2013 and has been penalised for the same.
A complaint was filed by Pankaj Prasad on the PG portal regarding the non-maintenance of the registered office by the company. The complainant stated that he had sent a letter to the company, which was returned undelivered as the company was not maintaining its registered office at the given address. This action has violated section 12 of the Companies Act.
As per the provision of Section 12(1) of the Company Act, 2013, every company must maintain a registered office that receives and acknowledges all communication and notices and should make sure that the office address is correct. However, the company has failed to comply with the provisions of this section.
The directors of the company stated that their registered office has been operating in hybrid model since Covid-19 to ensure the safety of their employees. They said that due to all this, the post might have returned back. However, it clearly shows the company was not complying with Section 12(1).

The company has been ordered to pay the penalty amount in online mode and within 90 days of receiving the order.
