What are the types of Trademark?

Product Mark

Product Mark helps to identify products or goods in place of services. The product is the unique selling feature of the company in the case of product mark.

Initially, the product marks are represented by TM, which signifies that the mark is not yet registered but it is in the process of registration. Once they are registered, the ‘®’ symbol is used which serves as a recognition in the market and automatically differentiates that particular product. Instances of a product mark are Pepsi®, Maggi®.

Service Mark

A service trademark is used to recognize and differentiate the services rather than the products provided by the company. The Service marks have a specific character known as ‘SM’. An example of a service mark is McDonald’s, which is a service mark for restaurant services.

Collective Mark

Collective marks are related to a group of people and not one single product/service. These trademarks are mainly owned by an organization or any association that is related to several members.

An example for the collective mark is the “CS” device. It is used by the members who fall under the Institute of Company Secretaries.

Certification Mark

This is created to show the standard of a company i.e. it is to prove that a merchant’s goods or services are certified as they are meeting particular required standards.

Examples: Wool mark, ISI is the example of Certification Mark.

Shape Mark/Pattern Mark

This kind of mark is used in order to create differentiation between the products.

Sound Mark

It is introduced for registration of sound graphics that differentiate the products and services of one from another. Example – Nokia tune

What documents are required for the purpose of Trademark Registration?

The documents required for registering trademark are as mentioned below:

  • Soft copy of the trademark to be registered
