CA Professional Misconduct: ICAI Removes Names of 12 Chartered Accountants from Members Register

The Institute of Chartered Accountants of India [ICAI] has removed the name of 12 Chartered Accountants from the member’s register. The Disciplinary Committee of the Institute of Chartered Accountants of India (ICAI) has found Chartered Accountants guilty of professional misconduct. Names of these Member has been removed from the Register of ICAI.

Disciplinary Committee has held CA. Navinchandra Virji Gada (Membership No. 123936), Flat No. 201 2nd Floor, Ratna Tarang Cooperative Society, A wing, Old Nagardas Road, Above Amardeep Nursing Home, Andheri(East), MUMBAI 400069, guilty of Professional Misconduct falling within the meaning of Clauses (5),(7) and (9) of Part I of Second Schedule to the aforesaid Act and consequently ordered for removal of name of CA. Navinchandra Virji Gada (Membership No. 123936) from the Register of Members for a period of 02(Two) years and also imposed a fine of Rs. 50,000/- (Rupees Fifty Thousand Only) to be paid within 30 days which is also upheld by the Appellate Authority vide its order pronounced on 5th October, 2022. In pursuance of the aforesaid Order of the Disciplinary Committee and in exercise of the powers conferred by sub-section (2) of Section 20 of the aforesaid Act, read with Regulation 18 of the Chartered Accountants Regulations 1988, it is hereby notified that the name of CA. Navinchandra Virji Gada (Membership No. 123936) shall stand removed from the Register of Members for a period of 02(Two) years with effect from 11th November, 2022.

Disciplinary Committee has held CA. Valady Vaidhyanathan Ramanathan (Membership No. 010291), No. 20 (Old No. 29), Flat C-2, Balajee Apartments, Neelakanta Metha Street, CHENNAI 600017, guilty of Professional Misconduct falling within the meaning of Clause (1) of Part II of Second Schedule to the aforesaid Act and consequently ordered for removal of name of CA. Valady Vaidhyanathan Ramanathan (Membership No. 010291) from the Register of Members for a period of 02(Two) months and also imposed a fine of Rs. 5,00,000/-(Rupees Five Lakhs) only to be paid within 3 (three) months and in case of default in payment of fine within stipulated time, his name be removed for additional 1(one) month. Since the Respondent had failed to pay the imposed fine within stipulated time, in pursuance of the aforesaid Order of the Disciplinary Committee and in exercise of the powers conferred by sub-section (2) of Section 20 of the aforesaid Act, read with Regulation 18 of the Chartered Accountants Regulations 1988, it is hereby notified that the name of said CA. Valady Vaidhyanathan Ramanathan (Membership No. 010291), shall stand removed from the Register of Members for a consolidated period of 03(Three) months [02(two) months plus additional 1(one) month] with effect from 11th November, 2022.

Disciplinary Committee has held CA. K Sridhar Reddy (Membership No. 221286), H No. New 2-10-1622(Old No. 2-10-1220), Chaitanyapuri, KARIMNAGAR (Telangana) 505002, guilty of Professional Misconduct falling within the meaning of Clause (1) of Part II of Second Schedule to the aforesaid Act and consequently ordered for removal of name of CA. K Sridhar Reddy (Membership No. 221286) from the Register of Members for a period of 01 (One) month and also imposed a fine of Rs. 5,00,000/-(Rupees Five Lakhs) only to be paid within 3 (three) months and in case of default in payment of fine within stipulated time, his name be removed for additional 1(one) month period. Since the Respondent had failed to pay the imposed fine within stipulated time, in pursuance of the aforesaid Order of the Disciplinary Committee and in exercise of the powers conferred by sub-section (2) of Section 20 of the aforesaid Act, read with Regulation 18 of the Chartered Accountants Regulations 1988, it is hereby notified that the name of said CA. K Sridhar Reddy (Membership No. 221286), shall stand removed from the Register of Members for a consolidated period of 02(Two) months [01(one) month plus additional 1(one) month] with effect from 11th November, 2022.

Disciplinary Committee has held CA. Chandan Singh Chauhan (Membership No. 401474), C S Chauhan And Associates, Flat No. A703, Sriniketan Apartment, Shyam Karan Road, HYDERABAD (Telangana) 500007, guilty of Professional and Other Misconduct falling within the meaning of Item (7) of Part I of the Second Schedule( in case no. PR-63/2014-DD/172/2014-DC/790/2018 ) and Items (4),(6),(7) and (8) of Part I and Item (1) of Part II of Second Schedule and Item (2) of Part IV of the First Schedule (in case no. PR-267/2016- DD/292/2016-DC/1384/2020), to the aforesaid Act and consequently ordered for removal of the name of aforesaid CA. Chandan Singh Chauhan (Membership No. 401474) from the Register of Members for a period of 01(One) year alongwith a fine of Rs. 25,000/- (Rupees Twenty Five Thousand) only in respect of the first case and removal for a period of 02(two) years alongwith a fine of Rs. 25,000/- (Rupees Twenty Five Thousand) only in respect of the second case. The Disciplinary Committee also ordered that if the Respondent fails to deposit the fine within the stipulated time i.e. 3 months in the said cases, his name should be removed from the Register of Members for a further period of 01(one) month for each such said case and that the said punishments shall run concurrently in both the aforesaid cases. Since, the Respondent failed to deposit the imposed fine as stipulated in both cases, in pursuance thereof and in exercise of the powers conferred by sub-section (2) of Section 20 of the aforesaid Act, read with Regulation 18 of the Chartered Accountants Regulations, 1988, it is hereby notified that the name of said CA. Chandan Singh Chauhan (Membership No. 401474), shall stand removed for a consolidated period of 02(Two) years plus additional 02(Two) months from the Register of Members with effect from 11th November, 2022.

Disciplinary Committee has held CA. Balasubramaniyan S (Membership No. 020320), C/o Bhaggyam, Castle No. 20, Raman Street, T Nagar, CHENNAI 600017, guilty of Professional and Other Misconduct falling within the meaning of Item (7) of Part I of Second Schedule and Item (2) of Part IV of First Schedule to the aforesaid Act and consequently ordered for removal of name of CA. Balasubramaniyan S (Membership No. 020320) from the Register of Members for a period of 06(Six) months and also imposed a fine of Rs. 2,00,000/- (Rupees Two Lakhs Only) to be paid within 3 (three) months and in case of default in payment of fine within stipulated time his name be removed for a period of additional 1(one) month. Since the Respondent has already paid the imposed fine within stipulated time, in pursuance of the aforesaid Order of the Disciplinary Committee and in exercise of the powers conferred by sub-section (2) of Section 20 of the aforesaid Act, read with Regulation 18 of the Chartered Accountants Regulations 1988, it is hereby notified that the name of CA. Balasubramaniyan S (Membership No. 020320) shall stand removed from the Register of Members for a period of 06(Six) months with effect from 11th November, 2022.

Disciplinary Committee has held CA. C V Kittur (Membership No. 006970), Anu-Vir-Park, Basav Nagar, Club Road, BELAGAVI(Karnataka) 590001, guilty of Professional Misconduct falling within the meaning of Items (7) and (8) of Part I of Second Schedule to the aforesaid Act and consequently ordered for removal of name of CA. C V Kittur (Membership No. 006970) from the Register of Members for a period of 06(Six) months. In pursuance of the aforesaid Order of the Disciplinary Committee and in exercise of the powers conferred by sub-section (2) of Section 20 of the aforesaid Act, read with Regulation 18 of the Chartered Accountants Regulations 1988, it is hereby notified that the name of CA. C V Kittur (Membership No. 006970) shall stand removed from the Register of Members for a period of 06(Six) months with effect from 11th November, 2022.

Disciplinary Committee has held CA. Thiruveedhi Parthasaradhi (Membership No. 013477), Plot No. 67, Paigha Colony, S P Road, SECUNDERABAD (Andhra Pradesh) 500003, guilty of Professional Misconduct falling within the meaning of Items (8) and (9) of Part I of First Schedule and Items (5) and (7) of Part I of Second Schedule to the aforesaid Act and consequently ordered for removal of name of CA. Thiruveedhi Parthasaradhi (Membership No. 013477) from the Register of Members for a period of 03(Three) months and also imposed a fine of Rs. 25,000/- (Rupees Twenty Five Thousand Only) to be paid within 3 (three) months and in case of default in payment of fine within stipulated time his name be removed for a period of additional 1(one) month. Since the Respondent has already paid the imposed fine within stipulated time, in pursuance of the aforesaid Order of the Disciplinary Committee and in exercise of the powers conferred by sub-section (2) of Section 20 of the aforesaid Act, read with Regulation 18 of the Chartered Accountants Regulations 1988, it is hereby notified that the name of CA. Thiruveedhi Parthasaradhi (Membership No. 013477) shall stand removed from the Register of Members for a period of 03(Three) months with effect from 11th November, 2022.

Peter Jaya Rao (Membership No. 210919), 39/1, 12th Cross, St. Marys Road, N R Mohalla, MYSURU (Karnataka) 570007, guilty of Professional and Other Misconduct falling within the meaning of Item (7) of Part I of Second Schedule and Item (2) of Part IV of First Schedule to the aforesaid Act and consequently ordered for removal of name of CA. Peter Jaya Rao (Membership No. 210919) from the Register of Members for a period of 01(One) month. In pursuance of the aforesaid Order of the Disciplinary Committee and in exercise of the powers conferred by sub-section (2) of Section 20 of the aforesaid Act, read with Regulation 18 of the Chartered Accountants Regulations 1988, it is hereby notified that the name of CA. Peter Jaya Rao (Membership No. 210919) shall stand removed from the Register of Members for a period of 01(One) month with effect from 11th November, 2022.
