THE WESTERN MAHARASHTRA TAX PRACTITIONERS ASSOCIATION has made a representation to Smt. Nirmala Sitharaman Union Minister of Finance, Government of India & Chairperson GST Council requesting extension of due date for filing of GST Return for flood effected areas of Maharashtra, Karnataka, Kerala Andhra Pradesh Gujarat.

Subject: Request for Relief by way of Due date Extension for GST Annual Return and Monthly Return, from Disastrous Flood Situation in state of Maharashtra, Karnataka, Kerala Andhra Pradesh Gujarat
Respected Madam,
The Western Maharashtra Tax Practitioners Association WMTPA, (formerly known as The ITSTP Association) was formed in 1950 with the object to assist the professionals and resolve common problem faced by the tax professional. WMTPA is one of the largest associations of Tax Practitioner in Maharashtra state and having about 1400+ members consisting of Tax consultants, advocates, chartered accountants & cost accountants who are practicing in taxation, corporate and other allied laws. Associations primary objective is to help the members to get acquaint with changes in various laws as well to help the government, by representing, issues faced by taxpayers as well as professionals.
We have written to your good self of various issues faced by taxpayer and professionals while filing GST Annual Return and Audit. Recently, Chairman of CBIC, Shri Pranab Das, in his letter dated 6th Aug 2019, has expressed serious concern on compliance status of Form GSTR 9 and GSTR 9C, as only around 1% said forms are filed till date. One of the reasons for this lesser compliance percentage is complexity of form and irrelevant complex information asked in said form. Due date for filing these forms is 31st Aug 2019.
However, now said compliance situation is going to be worst in coming days, due to heavy rain in various parts of country, which has destroyed daily life of millions of people.
a) We would like to highlight to your good office, of which you must be aware that, there is heavy rainfall in state of Maharashtra, Karnataka, Kerala, Andra Pradesh and Gujarat which has caused disastrous situation of flood.
b) Heavy Rain and Flood in above mentioned state has severely impacted personal, working and professional life of all individual, Taxpayer and Professional living in these state
c) Neither Tax payer are able to communicate to professionals, nor professionals are not able to communicate tax payer for GST Compliance.
d) Office of Tax payer and Professionals are badly damaged due to flood.
e) Life of all people in above mentioned state sareseverely impacted.
Therefore, it is impossible for taxpayers of above mentioned states, to do any Tax compliance for coming 1-2 month, until situation improves and come back to normal. We are deeply saddened that, still there is nosuomotorelief by way of date Extension by GST Council, knowing the situation on all these state. GST Council should help in such situation to taxpayer, who contribute for growth of country by several means.
It is unhuman, to ask to do tax compliance, file monthly and annual GST Return for all taxpayer within above mentioned states. Indeed, somehow, we all are trying to help severely affected people by way of supplying food and Medical Help.
Therefore, we humbly request for immediate
Three month Date Extension for GST Annual Return (GSTR 9, GSTR 9A) and GST Reconciliation Statement ( GSTR 9C) up to 30th Nov 2019
Due Date Extension for Monthly / Quarterly GST Return of July 19 and Aug 19 up to 30th Nov 2019
We are hopeful that government will understand concern explained by us and will come out with positive action on urgent basis.
