A resort in Jaipur has filed an FIR against travel booking platform OYO when it received GST Notices of crores, stating that the notice was on the basis of “wrong” data or information that had been given by OYO.

The FIR was filed on a complaint submitted by Madan Jain, associated with Samskara resorts, in Jaipur’s Ashok Nagar police Station last week. Further, Jain said that Samskara Resorts got a GST show Cause notice of Rs. 2.66 crore. In the FIR, Jain has stated that “to show an inflated annual turn-over, thousands of fake bookings were shown in the name of Samskara resort.”

Oravel Stays Private limited or OYO, as well as the founder and group CEO of OYO and many others, were named by Jain in the FIR. The FIR has been filed against OYO on charges of cheating, criminal breach of trust, forgery and criminal conspiracy under the Bharatiya Nyaya Sanhita (BNS).

In the FIR it is claimed that Samskara Resort in Jaipur gives services through online booking and walk-ins also. Jain also stated that there is a contract signed between Samskara and OYO on April 18, 2019, for a year, but OYO also said to have shown bookings in Samskara for the fiscal years 2018-19, 2019-20 and 2020-21.

The FIR mentions that between April 18, 2019 and April 20, 2020, OYO gives sanskara a business of Rs. 10.95 lakh and its gst was paid by the resort. Although OYO has shown a business of Rs. 22.22 crore with samskara for which the GST bill of Rs. 2.66 crore was pending, except for the penalty.

President of the Hotel Federattion od rajasthan, claimed that GST notices have been sent to around 20 hotels on the basis of excessive charges represented by OYO. He also stated that OYO did not have good record with hotels, as well as four years also, too, “we had campaigned against it, with 125 hotels displaying banners outside the hotels stating that we are not accepting OYO bookings.”
