The government has released draft amendments to the Trade Marks Rules, 2017, inviting public feedback within 30 days of notification.

Government Seeks Public Comments on Proposed Trademark Rule Changes The Ministry of Commerce and Industry (Department for Promotion of Industry and Internal Trade) recently shared a notification on October 31, 2025 regarding changes in the Trade Marks Rules, 2017. The government is planning to make some changes to the Trade Marks Rules, 2017 in powers given by sub-section (2) of section 157. They are publishing the proposed changes so that everyone who might be affected can see them. People have 30 days from the date the notification appears in the Gazette of India to read and consider these draft rules. After that period, the government will review the feedback and may finalise the rules. The Government of India also invites objections and suggestions, if any, which may be addressed to the Secretary, Department for Promotion of Industry and Internal Trade, Ministry of Commerce and Industry, Government of India, Vanijya Bhawan, New Delhi-110011 or by e-mail at [email protected].

Any comments or suggestions that people send about these draft rules before the deadline will be reviewed by the Central Government. Draft Rules 1. In the Trade Mark Rules 2017, after Rule 2(1)(e), the following will be placed: "2(1)(ea). "Code of Conduct" means the Code of Conduct which may be published from time to time by the Registrar of Trade Marks in the Fifth Schedule and journal as per Rule 143(2). 2. The following will be placed in Principal Rule, after Rule 2(m): "2(1) (ga). "Disciplinary Committee" means a committee constituted as per Rule 151D."

3. The following will be placed in Principal Rule, after Rule 2(m). "2(ma). "Officer" for the purposes of Rule 151C means an Officer who is authorised by the Registrar of Trade Marks under Section 3 of the Trade Marks Act, 1999." 4. In the Principal Rule, in Rule Clause (b) of Subsection (2) of Section 151 will be removed. For complete information refer to the official notification.
