Govt Authorises ESIC Officers to Recover Damages Under Social Security Code, 2020
The Ministry of Labour and Employment under the Government of India has granted authorisation to certain officers of ESIC to use the powers and perform the functions concerning recovery of damages under the provisions of Chapter IV of the Code on Social Security, 2020.
The government has taken this aforementioned action in pursuance of its powers granted under Section 128 of the Code on Social Security, 2020 (36 of 2020), and notified the same through an Official Notification No. S.O. 2358(E), dated May 08, 2026.
According to the said notification, officers with designations including Insurance Commissioner or Additional Commissioner or Regional Director Grade ‘A’/Director or Regional Director Grade ‘B’/Joint Director or Deputy Director have now been permitted to exercise the powers and perform the functions relating to the recovery of damages within the jurisdiction granted by the Employees’ State Insurance Corporation (ESIC).
