Gujarat HC Quashes Order for Confiscation, as Show Cause Notice was Sent After Statutory Deadline
The Gujarat High Court in the matter of Amit Harishkumar Doctor vs Union of India has quashed the order for confiscation by the customs department, and held that the order is invalid under the law since the show cause notice was sent after the statutory deadline.
The bench held that the Respondents shall return the cash and articles/goods to the petitioner not later than period of eight weeks seized from the petitioner. Respondents shall be at liberty to initiate action of adjudication, in accordance with law, if permissible under the law otherwise.
The order was made by Honourable Ms. Justice Sonia Gokani and Honourable Mr. Justice Hemant M. Prachchhak
The Appellant i.e. Amit Harishkumar Doctor represented by Advocate Mr. S S IYER and the Respondent i.e. Union of India was represented by Advocate Priyank P Lodha.
