Recently, the Honourable Punjab and Haryana High Court has strongly criticised the counsel of CBDT for non-compliance with the orders of the Honourable Gujarat High Court regarding the extension of the income tax return (ITR) due date for audit cases. The court said if the ITR due date has still not been extended, then it will be considered a clear disrespect of the High Court's order.
In mid-October 2025, the Gujarat High Court directed the Central Board of Direct Taxes (CBDT) to extend the due date for filing the Income Tax Return (ITR) till November 30, 2025, for taxpayers liable to get their accounts audited. This order came after the CBDT extended the due date for Tax Audit Reports (TARs) filing to October 31, 2025, but kept the ITR filing due date for audit cases unchanged, i.e., October 31, 2025. This violated the statutory gap of one month between the two deadlines.
The judgment was titled Income Tax Bar Association & Anr. Vs Union of India and Ors. The Gujarat High Court ruled that the Income Tax Act says that there should already be a one-month period gap between the Tax Audit Report (TAR) and Income Tax Return (ITR) filing deadlines. Hence, the court instructed the CBDT to confirm the ITR filing due date extension till November 30, 2025, through an official circular release.
The CBDT has requested the Court for more time, saying that the issue is still being looked into by the CBDT Chairman. However, the court has only postponed the hearing until 1:45 PM today and told the lawyer to make sure that the extension order is issued by then. It is expected that the issue will be settled in favour of taxpayers today and that the much-awaited extension will finally be announced.
