Income Tax Officers Can Access Your Email and Social Media: What You Need to Know?

From 1 April 2026, the Income Tax Department will have the legal right to access your social media accounts, personal emails, bank accounts, online investments, and trading accounts if they suspect tax evasion. If they believe you have hidden income, money, gold, jewelry, property, or any valuable assets or property on which tax has not been paid as per the Income Tax Act, 1961, they can investigate and take necessary action.

Section 132 of the Income Tax Act of 1961 gives the authorized officer the power to conduct searches and seize assets or financial records. This happens when they have a valid reason or information to believe that a person is hiding income, property, or important documents to avoid paying income tax.

One method they can follow to do this, as per current laws, is by breaking a lock on a door, box, or locker if the keys are not available. This is allowed if they have a valid reason to believe that hidden assets or financial records are stored inside.

Under the new income tax bill, authorities now have the power to access and search your computer or digital space.

What Modification in the new income tax bill authorizes this:

The Income Tax Bill provides a clear definition of virtual digital space. It states that a person’s social media accounts, bank accounts, trading and investment accounts, and emails are all considered part of a virtual digital space.

According to the new Income Tax Bill, virtual digital space refers to a digital environment created and experienced through computer technology rather than the physical world. It includes any online space where users can interact, communicate, and perform activities using computer systems, networks, resources, communication devices, the internet, and emerging technologies. This space enables the creation, storage, and exchange of data and information in electronic form and includes:

  • Social Media Account
  • Email Servers
  • Online investment account, trading account, banking account, etc
  • Remote servers or cloud servers
  • Digital application platforms
  • Any website used for storing details of ownership of any asset
  • Any other space of a similar nature

Who can act as an authorized officer?

As per the income tax bill, the term authorized officer means:

1. The Joint Director or the Additional Director
2. The Assistant Director or the Deputy Director
3. The Assistant Commissioner or Deputy Commissioner
4. The Joint Commissioner or the Additional Director
5. The income tax Officer or the Tax Recovery Officer
