Practicing Company Secretaries can’t practice as a Trademark Agent

The Ministry of Commerce and Industry vide a letter has stated that Practicing Company Secretaries (CS) can’t practice as a Trademark Agents.

The Content of the letter is as given below:

This is in reference to your request on form TM-G dated 11/12/2022 received in this office for registration as a Trade Mark Agent that it has been observed that The Company Secretaries Act, 1980 does not list the Trade Marks Act, 1999 for simultaneously practicing, before the Trade Mark Registry.

In view of the above, I am directed to inform you that you are required to submit an Affidavit stating that after registration as a Trade Mark Agent you will not be practicing as a Company Secretary. The same shall be submitted by the Trade Marks Registry to the Institute of Company Secretaries of India for bringing this matter to their knowledge.

The above said Affidavit needs to be submitted within thirty days from the receipt of this notice. Afier receipt of the above mentioned affidavit, the office shall do the needful.
