The state government has formed an advanced-level committee to make rules for flat owners in the state who are issued with vertical property cards.

This move aims to provide flat owners with legal ownership of their lands to ensure transparency in property records. This action will provide owners assurance that their lands are legally theirs only and no one other has the right on their lands.

The additional chief secretary (revenue department) will chair the committee. The Senior officials from the cooperation, urban development, rural, and law departments, along with the settlement commissioner and director of land records, Pune, will be included in the committee.

Sanjay Bankar, joint secretary of the revenue and forest department, issued a government order regarding the initiative on October 30.

The government wants to make the system of recording apartment ownership the same across the state. A committee will look at how other states handle this and create a plan so that every flat owner’s share of land is clearly shown on the property card or 7/12 record, officials said.

Presently, the details of ownership, like purchase, inheritance, or lease, are recorded on property cards under Sections 149 to 151 of the Maharashtra Land Revenue Code, 1966. But there is no uniform or standard way to register apartment ownership under the Apartment Act.

To include apartment ownership details in the official land records and clearly show how the common area and common areas and the land under the building are shared, the panel will prepare rules.

The new property card will be treated as a legal document to show the total land area of the building and each flat owner’s share in that land.

An officer from the Revenue has said, “Once implemented, every flat owner will have clear legal proof of ownership, which will also help avoid disputes and simplify property transactions.”
