Madras HC Permits Withdrawal of Plea for Income Tax Probe Against Vijay

The Madras High Court on June 2, 2026 allowed the withdrawal of a petition seeking an inquiry into Chief Minister and TVK chief C. Joseph Vijay for alleged suppression of income.

The division bench comprising Chief Justice S A Dharmadhikari and Justice G Arul Murugan permitted the petitioner to withdraw the plea and issued the appropriate order.

The petitioner M. Rajkumar, Chennai, had sought the Principal Commissioner of Income Tax (Central) and Director General of Income Tax Investigation (DGIT) to review the documents, the findings from search procedures, affidavits from assessment procedures and the penalty order issued under the Income Tax Act against Vijay to initiate the necessary procedures.

Further, Rajkumar submitted that an FIR should be registered against Vijay by an appropriate law enforcement agency and the agency should investigate crimes that could be prosecuted under sections 420, 467, 470, 471 and 120B of the IPC in relation to alleged income suppression, receipt of unaccounted cash remuneration and concealment of financial transactions disclosed in search and statutory proceedings.

It is to be noted that this is the third petition filed in this case. The DGIT and Principal Commissioner were asked to produce the materials obtained during the search to the authorities under the Prevention of Money Laundering Act to investigate the existence of a scheduled predicate offence and proceeds of crime.

The court has ordered the Income Tax Department to file a response and send Vijay a notice in connection to the first petition, which is still pending and requests an inquiry.

The second petition, was denied on the grounds, which asked the Election Commission to conduct an investigation by saying that such orders could not be given following the announcement of elections.
