Additional DIN Obtained by Error Leads to Penalty Imposed by ROC Pune
The Registrar of Companies (ROC), Pune, imposed a penalty on an individual regarding the issue of having two DIN numbers.
The applicant filed a suo moto application under Section 454 of the Companies Act, 2013, read with the Companies (Adjudication of Penalties) Rules, 2014, and Section 155 of the Companies Act, 2013.
The application was submitted through Form GNL-1 (SRN AB5597380 dated August 04, 2025), and the physical copy was submitted on June 27, 2025.
The applicant informed ROC that Mr Deepak Vasant Patil already had a Director Identification Number (DIN) 07476832 when he became a director on May 25, 2016. This DIN is currently linked with Pasaydan Manufacturing and Marketing Private Limited and Pasaydan Healthcare Private Limited.
However, at the time of his appointment as a Designated Partner in Shriya Frameworks Infra LLP on June 09, 2023, another DIN (10196797) was mistakenly allotted to him. This happened unintentionally and without any wrongful intention.
The applicant became aware of this issue in January 2025 when a professional was working on incorporating a new LLP. After discovering the mistake, he immediately took steps to correct it and filed Form DIR-5 (SRN AB3329403 dated April 18, 2025) to surrender the second DIN (10196797).
However, the noticee did not request an e-hearing, and the adjudicating officer also decided that an e-hearing was not necessary in this case.
After considering all facts, submissions, and circumstances, and using the powers under Section 454(3)(a) of the Companies Act, 2013, the Adjudicating Officer imposed 50% of the maximum penalty on the noticee for violation of Section 155, which is punishable under Section 159 of the Act. As a result, the officer imposed a penalty of Rs 194,750 on Deepak Vasant Patil.
