Candidate and Middleman involved in cheating Pre-PG Examination sentenced to 4 Years Imprisonment

In the Pre-PG Examination 2009 held by Vyapam (M.P.), the Special Judge for CBI, Vyapam Cases, Gwalior, sentenced accused candidates Shri Ashutosh Gupta and accused middleman Shri Pankaj Gupta @ Chimman to four years of Rigorous Imprisonment with a fine of Rs.13,100 each.

In accordance with the orders of the Hon’ble Supreme Court of India, the Central Bureau of Investigation (CBI) filed the current case on August 13, 2015, after assuming the MP Police’s (PS Jhansi Road, Gwalior) FIR No. 97/15, dated March 21, 2015, against Sh. Ashutosh Gupta, Sh. Pankaj Gupta @ Chimman, and others.

It was alleged that Ashutosh Gupta had arranged a solver through Sh. Pankaj Gupta for a consideration of Rs.15 lakh (approx.) for the Pre PG-Exam 2009. Local Police had filed 2 Charge Sheets/supplementary charge sheet.

CFSL provided an opinion on the accused individuals’ handwritings and signatures throughout the CBI Investigation. According to CFSL Expert Opinion, accused candidate Sh. Ashutosh Gupta did not show up for the aforementioned Vyapam examination, which was held in Jabalpur, MP on April 12, 2009.

It was also discovered during the CBI investigation that the accused, Shri Ashutosh Gupta, was working as a medical officer at the Primary Health Centre Kariyawati, Gwalior on Saturday and Monday (the exam was on the intervening Sunday, April 12, 2009), and he had not requested permission to visit Jabalpur to appear in the aforementioned examination. Subsequent inquiry disclosed that candidate Sh. Ashutosh Gupta had communicated with intermediary Sh. Pankaj Gupta, who had arranged a solver for Sh. Ashutosh Gupta in the aforementioned Pre-PG 2009 Examination, in exchange for payment of fifteen lakh (approx).

Sh. Ashutosh Gupta paid the same to Sh. Pankaj Gupta after getting admission in the Gajra Raja Medical College.

Following the conclusion of its investigation, the CBI used the extra evidence it had gathered to file a supplemental chargesheet against the accused on January 5, 2018.

The defendants were found guilty by the trial court and given the appropriate penalty.
