Defamation notice to Dr. Kumar Vishwas for defaming members and esteemed member of ICSI

A Defamation notice was issued against Dr. Kumar Vishwas for defaming members of ICSI and esteemed members of ICSI in particular.

Advocate Akash Sharma has notified this via his twitter and LinkedIn handle. He wrote on his LinkedIn as, “Defamation Notice to poet Dr. Kumar Vishwas for Defamation of my client and members of ICSI in general and the esteemed member of ICSI in particular referred in the most derogatory manner in his speech delivered before the members of ICAI in their Annual Meet which was further uploaded most audaciously for public viewing in his YouTube page, tarnishing and maligning my client’s reputation and public standing as professionals being esteemed members of a professional body ICSI and seeking an unconditional public apology.”

He clarified in his notice that his client Mr. Vivek Mishra, is a Company Secretary by Profession and one of the members of The Institute of Company Secretaries of India, having his office at 7, Mangoe Lane, Room No. 212, 2nd Floor, Kolkata 700001, West Bengal.

The Notice issued as follows:

This notice is being issued on behalf of my Client who is hurt by the lowering of his public standing caused by the most irresponsible defamatory remarks made by you against ICSI members.

1. To the utter shock and dismay of my Client/s, it recently came to the knowledge of my Client that you have made false, frivolous, baseless, despicable and vexatious remarks without leading any cogent evidence against my Client and the entire fraternity of the members of the Institute of Company Secretaries of India of which my client is an associate member.

2. That in the course of your speech at the Annual Meet of The Institute of Chartered Accountants of India in Mumbai on 13th & 14th March, 2023, you made derogatory remarks against the members of Institute of Company Secretaries of India (ICSI) and the ICSI per se, In that speech you used contemptuous language by referring to a Company Secretary in a manner that has caused great disrespect to my client and brought disrepute to his CS profession and the Institute itself. For your kind information I bring it to your notice that there are more than 70,000 members of the ICSI across India who are deeply hurt and agonized by your remarks.

3 The exact lines used by you are reproduced herein below;

“MAIN JAHAN EK KASBE ME REHTA THA WAHA EK COMPANY SECRETARY SAJJAN THE, CA BHI NAHI THE. UNHONE GHAZIABAD KE KISI CA SE MUHAR LAGANE KA KAAM LE RAKHA THA. SAMAJH GAYE HONGE AAP! FORM 16 MILTA HAI US PAR HAR EK PAR WO 500 RUPAY SHAYAD WAHA JATE HONGE CA SAHAB KO AUR WO 2000 RUPAY MERE PITAJI SE LETE THE AUR SAAL ME EK BAAR BHAR JATE THE AUR BAAT KHATAM HO JATI THI”.

4. The said statements are ex facie irresponsible, frivolous, nonsensical, speculative, insinuating and defamatory. That remark was made without even inquiring into the certification referred and apparently based on hearsay. It was an assertion of distorted opinion rather than an assertion of a verified fact. Clearly, you could not have made that remark without conviction which clubbed you with prevaricators known for making preposterous utterances without any remorse causing social strife and unrest leading to unwarranted sufferings to a fraternity and its members.

5. The contents of your video have no iota of truth. They are totally false, unverified, based on hearsay and a deliberate and malicious attempt to defame the reputation of my Client and his entire fraternity of ICSI of which he is a member and the ICSI, its students and stakeholders per se. It is clear that ex facie you yourself could not honestly have believed in the truth of those allegations. The said false statements have been made intentionally to be hurtful to the feelings of my client and his CS fraternity. My client believes that you were paid a hefty amount of money for your speech by the organizers, and you made these statements to further your own vested interests.

6. That my client and the members of the ICSI are highly reputed professionals across the country. You have created a non-existent controversy in a sensational manner, by maligning the public image of my Client and his profession, for your own selfish and self-serving ends. Such malicious, unsubstantiated and reckless statements have deeply hurt the public standing and reputation of my Client and of course, of each and every stakeholders of his profession.
