Delhi Court Grants Anticipatory Bail in Rs. 75 Crore GST Fraud Case
The Patiala House Court in Delhi has given anticipatory bail to a person accused of running a Rs. 75 crore fake Input tax credit scam. Judge Chander Jit Singh noted that officials didn’t prove the accused might run away from justice and didn’t provide any solid evidence to support such concerns.
The accused is a law-abiding Indian citizen who runs a business as the Director of Rajnandini Metal Limited, which is registered with the GST Department. GST Intelligence officers had already searched his factory and home, thoroughly questioned him, and brought him to their office in Dwarka, New Delhi, for further investigation.
The accused reports that the officers of GST Intelligence fabricated facts and made him a scapegoat. He believes that they brought the case with a motive to intimidate him and extort money from him.
The accused resides permanently in Faridabad, is of clean character, and pays his taxes in time, demonstrating that he’s not likely to abscond from the law. He promised to cooperate with the investigation whenever needed and not to interfere with evidence or witnesses. He argued that putting him in jail would serve no useful purpose.
The court decided that since most evidence was in documents, the investigation was almost complete, and the maximum punishment was only five years, keeping the accused in custody wasn’t necessary, emphasizing that bail should be the normal practice, not the exception.
The court approved the anticipatory bail. To get this bail, the person must pay Rs. 200,000 as a bail bond. They also need one person to be their guarantor, who must be a family member and provide the same amount. This guarantor must be related to them by blood.
