1. The Bidder is expected to examine all instructions, forms, terms, and specifications in the bidding documents. Failure to furnish all information required as per the bidding documents or submission of a bid not substantially responsive to the bidding documents in every respect will be at the bidder’s risk and shall result in rejection of the bid. Confirm acceptance of all Techno-commercial terms in to without any reservation.

In case bidder is silent on any clause mentioned in this tender document KIOCL shall construe that the bidder had accepted all the clauses as per this Invitation to Tender.

2. KIOCL reserves the right to reject any or all the tenders without assigning any reason.

3. Tenderers shall furnish their quotation online in figures only.

4. KIOCL reserves the right to reject any or all tenders without assigning any reason.

5. KIOCL reserves the right to award part of the work or the whole, as may be considered necessary.

6. Acceptance of the bid will be intimated to successful bidder through a letter enclosing the copies of the Letter of Intent (LOI)/ Work Order and this letter / work order will be treated as authorization for award of work. The bidder shall sign, seal in all the pages of LOI/ Work order and send to KIOCL within seven days from the date of receipt of the same.

7. Period of Contract shall be for ONE (1) YEAR. The effective date of contract would be specified in LOI / Work Order.

8. Techno Commercial Terms and Conditions:

(i) PRICE: Offered price should be exclusive of GST.

Note:

a) GOODS & SERVICE TAX (GST): Percentage applicable to be indicated. KIOCL GST No. 29AAACK8438M1ZX. Applicable TDS will be deducted as per GST provision.
b) Bidders are requested submit their copy of GST Registration Certificate and PAN.
c) The price quoted shall be firm through-out the contract period and is not subject to escalation of any kind whatsoever.

General Terms and Conditions

i. Against this Enquiry for the subject item/system with detailed scope of supply as per our specification, KIOCL Limited, hereinafter referred to as KIOCL, may resort to “REVERSE AUCTION PROCEDURE” i.e. e-REVERSE AUCTION on INTERNET.

ii. For the proposed e-reverse auction, technically and commercially acceptable Agencies only shall be eligible to participate.

iii. e-Reverse auction will be conducted on schedule date & time.

iv. At the end of reverse auction event, the lowest Agency value will be known on the network.

Pre-Qualification Criteria:

Eligibility Criteria

1. Bidder should be a firm of Chartered Accountants/firm of Cost Accountants /firm of advocates who have continuous experience of 10 years or more in fulltime practice in Bangalore for GST/ Service Tax/VAT related matters. The cutoff date for ascertaining experience will be 31.03.2021. Minimum marks for 10 years experience will be 5. For each additional full year of experience, 1 additional mark will be awarded subject to maximum of 10 marks.

Copy of Certificate of firm firm’s registration issued by ICAI/Bar Council/cost Accountant

2. Minimum 4 partners with at least 2 partners having at least 10 years’ experience in the indirect taxation field. Minimum marks for the criteria will be 15. For each additional partner, 1 additional mark will be awarded subject to maximum 20 marks.

Documents Required

Resume of the partners and qualified CAs/CMA’s/ Advocates giving the brief details of relevant experience with membership no. and other documentary evidence establishing the fulfillment of criteria including details of cases in CESTAT and above.

Proof of execution of services / other credentials (e.g., appointment letter, certificate of completion indicating services provided etc).

3. Minimum 2 paid qualified chartered accountants or cost accountants (other than partners) or advocates out of which 1 should have at least 5 years of experience in Indirect Taxation field. Minimum marks for the criteria will be 15. For each additional paid chartered accountant/cost accountant/ advocate 1 additional mark will be awarded subject to maximum of 20 marks.

Resume of the partners and qualified CAs/CMA’s/ Advocates giving the brief details of relevant experience with membership no. and other documentary evidence establishing the fulfillment of criteria including details of cases in CESTAT and above.

Proof of execution of services / other credentials (e.g., appointment letter, certificate of completion indicating services provided etc).

4. Existing Partner(s)/ Paid Professionals having experience of handling at least one decided case before CESTAT and above in last five years. Minimum marks for the criteria will be 10, For each additional case handled in the last four years, 2 additional marks will be awarded subject to maximum 20 marks.

Documents Required

Resume of the partners and qualified CAs/CMA’s/ Advocates giving the brief details of relevant experience with membership no. and other documentary evidence establishing the fulfillment of criteria including details of cases in CESTAT and above.

Proof of execution of services / other credentials (e.g., appointment letter, certificate of completion indicating services provided etc).

5. The Bidder should have undertaken similar Service Tax/ GST assignments of at least two PSU or a listed Public Limited Company or Private Limited Company having annual revenue of more than Rs.1000 crore, for a continuous period of at least two (2) year in the last 4 years on continuous retainer ship basis. Minimum marks for the criteria will be 10. For each additional similar assignment handled for a continuous period of at least 1 year during last 4 years, additional 2 mark will be awarded subject to maximum of 20 marks.

Proof of execution of services / other credentials (e.g., appointment letter, certificate of completion indicating services provided etc).

6. Average annual financial turnover during the last three years, ending 31st March 2021The auditor should be a Chartered Accountant with UDIN No.

Minimum marks for the criteria will be 5. For each additional full Rs.10 Lakhs turnover, additional 1 mark will be awarded subject to maximum of 10 marks.

Documents Required

The bidder should have an average annual gross receipts / turnover of Rs. 50 Lakhs. (Audited Balance sheet or Form16 or Auditor certified copy of turnover with UDIN).
