In a case involving disproportionate assets, a special CBI court on Friday handed down a six-year rigorous imprisonment and a Rs. 5 lakh fine to a former Income Tax officer.
Rakesh Jain was previously given a four-year prison term by the court for receiving a Rs 50,000 bribe from a realtor in Sector 20 on February 6, 2013. His mother was also an accused in the case, but she died during the trial.
Jain was the subject of a complaint from Ashok Arora, who claimed that Jain demanded money in order to resolve notices the Income Tax authorities had issued to him. Jain reportedly wanted Rs 3.5 lakh, but the sale was settled for Rs 2.5 lakh. Jain was detained from his home at Sector 21 after Arora filed a complaint with the CBI. The CBI had retrieved from his home two gold bricks weighing one kilogramme each, paperwork referring to an investment of Rs 60 lakh in shares, and gold biscuits and jewellery weighing five kilogrammes from two bank lockers. In the disproportionate assets case, the CBI had presented a chargesheet in 2015. His wife was a defendant in the DA case as well, but she was cleared.
Invoking Jain's familial situation and other factors, the defence attorney requested forgiveness. The court stated that the convict "more appropriately merits a punishment that would serve as a deterrent to the other person in the society, so that they would think twice before committing such an offence."
