GST Fraud: Delhi Court grants Bail to Man in Rs.19 crore GST Fraud Case A Delhi court has granted bail to a man who is accused of passing GST input tax credits totaling of Rs.19 crores inadvertently. The accused was apprehended on Dec 1, 2022 and decided to kept into Judicial Custody till Dec, 14, 2022. It was claimed that Jagdish Bansal established four sole proprietorships and illegally claimed an input tax credit (ITC) under GST on the basis of false invoices, despite the fact that no goods were received. It was also claimed that by following this procedure, the proprietorship concerns received illegal ITC worth Rs 19.67 crores. It was also claimed that Jagdish Bansal admitted in his statement recorded under Section 70 of the Central Goods and Services Act, 2017, to running bogus businesses and passing on ITC on the basis of bogus invoices. When granting bail last week, Additional District Judge Sudhanshu Kaushik stated that no blanket ban on bail can be imposed simply because a person has been accused of an economic offence. In the current case, the applicant has been detained since December 1, 2022. The prosecution's report demonstrates that the accused's investigation has already been completed. In addition, the court stated in its order, "The prosecution has already recorded the statements of those involved, including the transporters. The necessary documents have been gathered. The fact that the prosecution never filed an application for custodial interrogation of the accused demonstrates that it is not warranted." The court also stated that the prosecution has opposed the bail application on the grounds that the accused is likely to try to influence the transporters, whose statements have been recorded. Bail cannot be denied based solely on the fear that the accused will try to influence the transporters, especially when no grounds for further incarceration are established. Jagdish Bansal the accused was granted bail on a Rs 15 lakh personal bail bond and two like amount sureties.
