It seems that there is a race among states to ratify the same. Today Telangana, Sikkim & Nagaland Legislative Assembly ratified the Goods and Service Tax (GST) Constitution Amendment Bill.
This month of AUGUST has seen real development in the GST front starting from the passing of GST Bill in Rajya Sabha on 03rd August and within few days being approved by the Lok Sabha on 08th August.
Today 3 more States i.e. Telangana, Mizoram & Sikkim ratified The Constitution 122nd Amendment Bil, 2014 commonly referred as GST Bill taking the total tally to 14 i.e. 2 short of minimum 16 required before it can be assented by the President to come into effect. The ratification has been done by states as below..
GST has been ratified by below mentioned states as on 30th August 2016 – 13 states + Delhi
1. Assam (12 August 2016)
2. Bihar (16 August 2016)
3. Jharkhand (17 August 2016)
4. Himachal Pradesh (22 August 2016)
5. Chhattisgarh (22 August 2016)
6. Gujarat (23 August 2016)
7. Madhya Pradesh (24th August 2016)
8. Delhi (24th August 2016)
9. Nagaland (26th August 2016)
10. Maharashtra (29th August 2016)
11. Haryana (29th August 2016)
12. Telangana (30th August 2016)
13. Sikkim (30th August 2016)
14. Mizoram (30th August 2016)
Further, Goa is expected to ratify the Bill tomorrow and Odisha on day after tomorrow which means once it is ratified by Odisha on 1st September, 2016 it may be legally presented to the President for his assent. In simple words, it’s possible that the Constitution may stand amended from 2nd September, 2016 onwards enabling simultaneous powers to the Centre and the States to levy Goods & Services Tax on the SUPPLY of Goods and/or Services by making respective laws.
With half the state legislatures expected to ratify the Constitution amendment bill (GST) by early September, the Centre is now moving to the next stage deciding on the contentious issue of fixing the rates.
Once 16 states ratify the Constitution amendment, and the President notifies it, the stage will be set for formation of the GST council, which will be the authority on deciding rates. Once the rates are decided, the upper limit will be included in the bill that will be moved in the Centre. Two more states to go after that president will notifies it. Rajasthan is expected to give its nod during the assembly session that has been convened from September 1.
