In response, the state defended its practices by citing a 2021 Standard Operating Procedure (SOP) designed to regulate the disposal of seized items.

The government emphasised that auctions are restricted to vetted buyers and that the nuts are sold under the strict condition that they be used solely for industrial or non-edible purposes, such as dyes. While the PIL underscores the dangers of contaminated food entering commerce, the state maintains that current safety guardrails are sufficient. The case highlights the necessity of rigorous "end-use" monitoring to ensure that high-volume seizures do not compromise public safety. HC Held: The High Court disposed of the PIL after recording the State’s assurance that strict adherence to the SOP dated 16.09.2021 is being maintained. The Court noted that the SOP includes multiple safeguards, such as requiring buyers to furnish undertakings restricting use to non-edible purposes, verification of credentials, and continuous monitoring by authorities. Relying on the State’s stand that all necessary precautions are being taken and enforced, the Court refrained from issuing further directions.
