High Court Grants Bail to Accused in GST Fraud Case Involving Bogus Input Tax Credit Claims

The Chhattisgarh High Court has granted bail to a man accused of wrongful availment of Input Tax Credit (ITC).

The accused, Anil Singh, who has been in custody since January 16, 2026, filed a First Bail Application under Bharatiya Nagarik Suraksha Sanhita, requesting the court to grant him regular bail.

Singh was arrested after an investigation at a firm named Ramdoot Enterprises uncovered that two other firms, M/s Sonam Sale and M/s Yuvraj Trading, where Anil Singh was a director, were engaged in facilitating “bogus billing”. These two firms allegedly claimed ITC through Ramdoot Enterprises without any actual supply of goods.

Singh allegedly availed ITC using fake invoices received through WhatsApp without any supporting documents like e-way bills, transport receipts, or physical movement of goods.

The department argued that Singh played a key role in this fraud and caused a huge loss to the government’s revenue.

Singh’s lawyer argued that he had been falsely accused in this case, claiming that there was no direct evidence or bogus invoices that had been found with him. He said that the investigation was almost complete and no other custodial interrogation was needed. Singh was willing to comply with any bail conditions set by the court.

The department warned that if bail is given to Singh, he might tamper with evidence or influence witnesses.

The court decided to grant bail to Singh, observing that the investigation is nearly completed, as Singh’s statement has been recorded and searches have also been conducted. The court said that in such a case, further custodial interrogation is unnecessary.

However, the bail was granted on the condition that Singh must furnish a personal bond of Rs 1,00,000 with a surety.
