High Court Quashes ITAT Order Dismissing Actor Jayasurya’s Income Tax Appeal for Non-Appearance:

The Kerala High Court has quashed an order of the Income Tax Appellate Tribunal that had dismissed an appeal filed by actor Jayasurya against an income tax assessment.

Justice A.A. Ziyadh Rahman said the appellate authority could not dismiss the actor’s appeal simply because he did not appear for the hearing. The court said the authority was required to consider the issues raised in the appeal and give proper reasons for its decision.

The petition was filed challenging the tribunal’s order. It argued that the authority had not considered or discussed any of the points raised by Jayasurya against the tax assessment.

The Income Tax Department, however, argued that Jayasurya had not submitted documents to support the grounds raised in his appeal. It said there was therefore no reason for the High Court to interfere with the tribunal’s order.

The High Court disagreed and said the appellate authority was required to examine and address the contentions raised in the appeal, even if the assessee did not appear for the proceedings.

The court held that the tribunal’s order did not meet the requirements of the Income Tax Act, 1961. It therefore set aside the order and quashed the dismissal of Jayasurya’s appeal.
