ICSI Representation to MCA for Extension of due date of filing Form BEN-1: ICAI Submits Representation to MCA for Extension of due date of filing Form BEN-1. The due date for the filing of Form BEN-1 is 9th May, 2019 and that of Form BEN-2 is within 30 days of receipt of declaration in Form BEN-1 However, the said e-forms Form BEN-1 and BEN-2, have not yet been made available on the MCA website is leading to practical difficulties for companies in complying with this requirement. In light of the above we request you to kindly consider the extension of last date for filing of the said Form BEN-I to 30 days from the date of availability of the form on MCA Website. This has reference to the Companies (Significant Beneficial Owners) Rules, 2018 as amended by MCA Notification dated 8th February, 2019 containing the Companies (Significant Beneficial Owners) Amendment Rules, 2019 where in Rule 3 reads as under: Rule 3: Declaration of significant beneficial ownership under section 90 (1) On the date of commencement of the Companies (Significant Beneficial Owners) Amendment Rules, 2019, every individual who is a significant beneficial owner in a reporting company, shall file a declaration in Form No. BEN-1 to the reporting company within ninety days from such commencement. (2) Every individual, who subsequently becomes a significant beneficial owner, or where his significant beneficial ownership undergoes any change shall file a declaration in Form No. BEN-1 to the reporting company, within thirty days of acquiring such significant beneficial ownership or any change therein.   The due date for the filing of Form BEN-1 is 9th May, 2019 and that of Form BEN-2 is within 30 days of receipt of declaration in Form BEN-1 However, the said e-forms Form BEN-1 and BEN-2, have not yet been made available on the MCA website is leading to practical difficulties for companies in complying with this requirement In light of the above we request you to kindly consider the extension of last date for filing of the said Form BEN-I to 30 days from the date of availability of the form on MCA Website Thanking you.
