The notices ask taxpayers to pay interest charges until the processing date of their Income Tax Return (ITR). The Gujarat Chamber of Commerce and Industry (GCCI) addressed the issue in a letter to the Central Board of Direct Taxes (CBDT).
Jainik Vakil, chairman of the GCCI's direct tax committee and chartered accountant, stated, "As per Section 140B(1), tax, interest, and fees must be paid before filing updated returns, and under normal circumstances, no demand notices should be issued. However, numerous taxpayers received recent notices of interest under Section 234B despite the fact that their taxes had been settled prior to filing, generating confusion and unneeded burden.
According to sources, Section 234B of the Income Tax Act stipulates the payment of interest for inadequate or nonpayment of advance tax. Section 140(1) requires assessees to pay income tax, interest, and fees before submitting new returns, supported by payment evidence.
Updated ITR submissions mandate the payment of interest under Sections 234A to 234C, as well as additional income tax, as required by Section 140B(3). For returns filed within 12 months of the assessment year's end, the extra income tax is 25% of the tax and interest, or 50% if filed within 24 months.
"The issue at hand is not the legitimacy of the additional income tax rate or how it is derived, but rather the calculation of interest under Section 234B. Recent concerns have arisen as taxpayers who filed updated returns after clearing their complete tax liabilities--including income tax, additional income tax, fees, and interest--receive demand notices once these returns are processed," said Vakil.
These notices were sent due to a mismatch in the interest calculation methodologies, he explained.
According to Vakil, the updated return filing utility calculates interest under Section 234B only until the return is filed. However, the intimation sent under Section 143(1) calculates interest under Section 234B up to the day the updated return is processed.
As a result, taxpayers who met all of their tax and interest responsibilities before to filing the updated return are now being requested to pay additional sums owing to processing delays. This has caused uncertainty and an unnecessary financial hardship for the affected taxpayers.
Vakil proposed amending Section 234B of the Income Tax Act to include a new sub-section dealing especially with interest computation for updated returns (ITR-U).
