Indore's Tax consultants and Business demand provision of Revision in GST Return
The significant business and tax consultant associations of the city as well as the state were joined to demand the provision of filing revised GST returns.
They claimed that it is their right because similar provisions are established in other tax regimes such as income tax and, earlier, VAT, central excise, and service tax systems.
On the invitation of the MP Tax Law Bar Association (MPTLBA) and the Commercial Tax Practitioners Association (CTPA), the city's and state's prominent business and tax organisations met on Saturday at Maheshwari Bhawan to discuss the demand for amended returns.
The meeting was attended by representatives from the Ahilya Chamber of Commerce and Industry, the Malwa Chamber of Commerce, the Tiles and Sanitary Association, the Iron Traders Association, the National Association of GST Professionals, the Madhya Pradesh Tax Law Bar Association, and the Commercial Tax Practitioners Association.
All participants agreed that the ability to file revised returns is a right of 1.40 crore registered taxpayers and more than 60 lakh tax professionals in business and law in the country, and that they have also been denied their rights under natural justice principles. They are not even allowed to state their case.
The meeting was attended by AK Lakhotia, president-MPTLBA; Ameet Dave, deputy president-NATP; Devendra Jain, president-CTPA; Sunil Jain and Ramesh Khandelwal, president-Ahilya Chambers of Commerce; and Ajitsingh Narang, president-Malwa Chamber of Commerce.
Pradeep Kanthed, a tax practitioner and Supreme Court lawyer, has petitioned the Supreme Court's double bench for the ability to file updated GST returns. The court approved the case and issued notices to the finance ministry, the CBIC, and the GST Council, in that order. The matter will be heard again on November 8th.
