MCA Appoints Justice (Retd.) Yogesh Khanna as Officiating Chairperson of NCLAT for Three Months

The Ministry of Corporate Affairs (MCA) under the Government of India has announced the appointment of Justice (Retd.) Shri Yogesh Khanna, a member (judicial) of the National Company Law Appellate Tribunal (NCLAT), as the officiating chairperson of NCLAT in accordance with Rule 7 of the Tribunal (Conditions of Service) Rules, 2021.
The aforementioned action has been taken following the completion of the term of Justice (Retd) Shri Ashok Bhushan in the role of NCLAT's Chairperson. His term was completed on July 04, 2026. The MCA has officially announced this update via a Notification No. S.O. 3722(E), dated July 08, 2026.
According to the notification, the aforesaid appointment has been made for the tenure period of three months with effect from July 05, 2026. The tenure will continue until a regular chairperson is appointed or until further orders are issued by the Central Government, whichever occurs earlier.
This appointment has been made to ensure continuity in the functioning of NCLAT until a permanent chairperson is selected by the Central Government.
The official notification reads "Consequent on the completion of the term of Office of Justice (Retd.) Shri Ashok Bhushan, as Chairperson, National Company Law Appellate Tribunal (NCLAT) on 04.07.2026, Central Government hereby appoints, Justice (Retd.) Shri Yogesh Khanna, Member (Judicial), NCLAT, as officiating Chairperson, NCLAT in terms of Rule 7 of Tribunal (Conditions of Service) Rules, 2021 for a period of three months with effect from 05.07.2026 or until a regular Chairperson is appointed or until further orders, whichever is earliest".
