Penalty of Rs. 5.5 Lakhs for Not Mentioning DIN: RD Confirms ROC Order
The present Appeal has been preferred under section 454(5) of the Companies Act, 2013, read with the provisions of the Companies (Adjudication of Penalties) Rules, 2014, vide Form ADJ bearing SRN no. F94668613 dated 29/04/2024 against the penalty order dated 21.02.2024 for the violation of section 158 of the Companies Act, 2013.
Section 158 deals with the obligation to indicate the Director Identification Number (DIN).
The office of the Registrar of Companies, West Bengal, had issued an Adjudication notice for violation of section 158 of the Act vide letter no. ROC/ADJ/2023/129697/7911/7916 dated 30.10.2023 to the Company and its Officers. In this regard, no reply was received by the ROC, West Bengal, from the Company and its officers for the aforesaid Adjudication notice.
RD refused to interfere, and the penalty imposed by ROC was confirmed.
