ROC Imposes Penalty on Director for Holding Two DINs
The Registrar of Companies (ROC) has recently issued a penalty order against a director of a company for violating the relevant provisions of the Companies Act related to Director Identification Numbers (DINs).
Sadhika Gupta, a director of Ambika Wheels Private Limited, had obtained two DINs. This is a clear violation of Section 155 of the Companies Act 2013, which strictly prohibits the directors from obtaining or possessing a second DIN.
As per a suo moto application filed by the company, the violation occurred due to ignorance and inadvertence. The director claimed that the non-compliance was not intentional.
As per the Companies Act, violating Sections 152, 155, and 156 of the Companies Act results in penalties of up to Rs 50,000. As a result, the ROC levied a penalty of Rs 50,000 on the director, which was required to be paid within 90 days through the MCA’s ‘e-Adjudication’ facility using her personal funds.
