RP cannot be Told that Despite Succeeding in appeal order couldn't be Passed Because of GSTN Glitches
A Registered Dealer Should not be Told that Despite Succeeding Before the Appellate Authority Order Could not be Passed Because of Technical Glitches of GSTN
The writ-applicant herein expresses his dissatisfaction with the fact that, notwithstanding his victory before the authority, respondent no.2 has yet to give effect to the Appellate Authority's order.
The Court dismissed this writ with a direction to respondent no. 2 to give effect to the Appellate Authority's order of 17.06.2020 as soon as possible, and to grant any consequential advantages available to the writ-applicant in line with law for the interregnum period.
Allow four weeks from the date of receipt of this order's writ to complete the necessary tasks.
Mr. Sharma, the learned AGP, expressed concern at this point that, due to technical difficulties, respondent no.2 may not be able to carry out the order issued by the appellate authority. Mr. Sharma seeks the assistance of respondent no. 3 – G.S.T.N.
The G.S.T.N. has authority over technological issues. A registered dealer should not be advised that, although winning at the appellate level, enforcing the authority's order is impossible due to technical difficulties. The problems with the technology should be fixed as soon as possible.
There should not be a complaint at the end of the writ-applicant hereunder that the appeal order has not been given effect next time.
