Supreme Court Criticizes govt for failing to appoint High Court judges

Supreme Court in the matter of M/S INDIAN SOLAR MANUFACTURERS ASSOCIATION v/s SOLAR POWER DEVELOPERS ASSOCIATION & ORS has criticized the government for not appointing Judges in High Court.

The issue raised in these petitions stems from the Government’s obstinate refusal to appoint High Court Judges for years despite the Collegium’s approval of the recommendations.

The High Court has only issued notice in the writ petition and the interlocutory applications, requesting that the parties file responses. This was hardly the stage of a case where the country’s Supreme Court should be called in.

The real snag is that the High Court does not believe such matters can be resolved at such a young age. This is a direct result of inadequacies in the number of High Court Judges, including in the country’s capital, where the Delhi High Court is located.

The Delhi High Court will have fewer than half of its judges, or 29 out of a total of 60.
