Businessman booked for Rs.12 Crore GST Fraud

A businessman has been charged with defrauding the UT excise department of 12.36 crore via fake input tax credit claims.

Deepak Bhatt of the UT excise and taxation department, Sector 17, alleged in his complaint that a firm called “SS Enterprises” was discovered to be non-existent at its major place of business in Sector 37.

According to the complaint, the firm’s proprietor, Surender, could not be located based on the paperwork supplied while registering for GST registration.

As a result, the department decided that the entity was a forgery that used GST registration to engage in unlawful input tax credit activities through phoney invoicing without actual goods movement.

Surender has been charged with criminal breach of trust under Sections 406 (criminal breach of trust), 420 (cheating), 467 (forgery of valuable security, will, etc), 468 (forgery for the purpose of cheating), 471 (Using as genuine a forged document or electronic record), and 120-B (criminal conspiracy) of the Indian Penal Code.
