Telangana Authority for Advance Ruling(AAR Telangana) in the matter of M/s. Kernex TCAS JV has ruled out that Contract for Design, Supply, Installation, Testing etc of Train Collision Avoidance System a Composite Contract for GST.

The Question was that (A) Whether the subject work falls under Works Contract? (B) What is the applicable rate of GST for this contract?.

The Authority Ruled out that the subject work is a composite supply and not works contract under GST. Being a composite supply, the rate applicable to principal supply is the rate applicable to the entire contract is GST@ 18% i.e., 9% CGST and also SGST.

The Appellant M/s. Kernex TCAS JV is executing a contract for South Central Railways for design, supply, installation, testing and commissioning of onboard train collision avoidance system (TCAS).

The Ruling made by Sri B. Raghu Kiran and Sri S.V. Kasi Visweswara Rao.
