DGFT Notifies Implementation of MoUs between India and various Countries concerning Import of Tur/Urad pulses and Pigeon peas

The Directorate General of Foreign Trade(DGFT) vide Public Notice No. 17/2015-20 dated 18th July 2022 regarding the implementation of the MoUs between the Government of Republic of India and (i) the Government of the Republic of the Union of Myanmar for import of urad and tur from Myanmar, (ii) Government of Republic of Malawi for import of pigeon peas from Malawi, (iii) Government of Republic of Mozambique for import of pigeon peas from Mozambique.

The Public Notice is Given Below:

S.O. (E): In exercise of powers conferred under paragraph 1.03 and 2.04 of the Foreign Trade Policy (2015-2020) and in continuation of –

(i) Public Notice No.22/2015-20 dated September 06, 2021 regarding MoU between Government of the Republic of India and the Government of the Republic of the Union of Myanmar for import of 2,50,000 MT of urad and 1,00,000 MT of tur from Myanmar,

(ii) Public Notice No.21/2015-20 dated September 06, 2021 regarding MoU between Government of the Republic of India and Government of Republic of Malawi for import of 50,000 MT of pigeon peas from Malawi, and

(iii) Public Notice No.44/2015-20 dated March 19, 2021 regarding MoU between Government of the Republic of India and Government of Republic of Mozambique for import of 2,00,000 MT of pigeon peas from Mozambique, the Director General of Foreign Trade hereby lays down the procedures/ modalities for complying with the aforesaid provisions under the MoUs:

1. In pursuance of the Memorandum of Understanding (MoUs) between the Government of the Republic of India and the Government of the Republic of the Union of Myanmar, India has agreed to provide an annual quota of 2,50,000 MT of Urad and 1,00,000 MT of Tur of Myanmar origin to be imported, through private trade, over the next five financial years, i.e., from 2021-22 to 2025-26 (April to March). Accordingly, 2,50,000 MT of Urad and 1,00,000 MT of Tur to be imported from Myanmar, is allowed for import for each fiscal year during the period 2022-26, subject to the following conditions:

a. Import will be allowed only through the following 5 ports: (i) Mumbai, (ii) Tuticorin, (iii) Chennai, (iv) Kolkata and (v) Hazira.

b. Import will be subject to production of “Certificate of Origin” certified by the authorized signatories of Department of Trade, Ministry of Commerce with stamps provided by the Government of Myanmar, which is being shared with the concerned Customs authorities of the above ports and CBIC.

c. While providing the Origin Certificate (including details of the exporter, importer and quantity of pulses), the designated issuing authority shall send a scanned copy of the certificate to the e-mail ID: ddg1import-dgft@gov.in

d. The Indian importer shall apply for registration/NOC through the DGFT Website → Services → Import Management System → Apply for Registration Certificate for Imports. The importer shall mandatorily upload the Certificate of Origin as part of the said online application.

2. In pursuance of the Memorandum of Understanding between the Government of the Republic of India and the Government of Republic of Malawi, India has agreed to provide an annual quota of 50,000 MT of tur (pigeon peas) from Malawi origin to be imported, through private trade, over the next five financial years, i.e., from 2021-22 to 2025-26 (April to March). Accordingly, 50,000 MT of tur (pigeon peas) to be imported from Malawi, is allowed for import for each fiscal year during the period 2022-26, subject to the following conditions:

a. Import will be allowed only through the following 5 ports: (i) Mumbai, (ii) Tuticorin, (iii) Chennai, (iv) Kolkata and (v) Hazira.

b. Import will be subject to production of “Certificate of Origin” certified by the authorized signatories of Customs & Excise Division of Malawi Revenue Authority with stamps provided by the Government of Myanmar, which is being shared with the concerned Customs authorities of the above ports and CBIC.

c. While providing the Origin Certificate (including details of the exporter, importer and quantity of pulses), the designated issuing authority shall send a scanned copy of the certificate to the e-mail ID: ddg1import-dgft@gov.in

d. The Indian importer shall apply for registration/NOC through the DGFT Website → Services → Import Management System → Apply for Registration Certificate for Imports. The importer shall mandatorily upload the Certificate of Origin as part of the said online application.

3. In pursuance of the extended Memorandum of Understanding between the Government of the Republic of India and the Government of the Republic of Mozambique on cooperation in the field of production and marketing of pigeon peas, India has agreed to provide an annual quota of 2,00,000 MT of tur (pigeon peas) from Mozambique origin to be imported, through private trade, during 2022-26. Accordingly, 2,00,000 MT of tur (pigeon peas) to be imported from Mozambique, is allowed for import for each fiscal year during the period 2022-26, subject to the following conditions:

a. Import will be allowed only through the following 5 ports: (i) Mumbai, (ii) Tuticorin, (iii) Chennai, (iv) Kolkata and (v) Hazira.

b. Import will be subject to production of “Certificate of Origin” certified by the authorized signatories in the ICM (Instituto de Cereasi de Mocambique) with stamps provided by the Government of Mozambique, which is being shared with the concerned Customs authorities of the above ports and CBIC.

c. While providing the Origin Certificate (including details of the exporter, importer and quantity of pulses), the designated issuing authority shall send a scanned copy of the certificate to the e-mail ID: ddg1import-dgft@gov.in

d. The Indian importer shall apply for registration/NOC through the DGFT Website → Services → Import Management System → Apply for Registration Certificate for Imports. The importer shall mandatorily upload the Certificate of Origin as part of the said online application.

Effect of this Public Notice: Online Procedures / modalities for each fiscal year during the period 2022-26 for import under the Memorandum of Understandings (MoUs) between Government of the Republic of India and (i) the Government of the Republic of the Union of Myanmar for import of 2,50,000 MT of Urad and 1,00,000 MT of tur from Myanmar, (ii) Government of Republic of Malawi for import of 50,000 MT of pigeon peas from Malawi, (iii) Government of Republic of Mozambique for import of 2,00,000 MT of pigeon peas from Mozambique are laid down.
