GST Department of Rajasthan notifies Amnesty Scheme 2024

In the latest development, the Rajasthan GST Department released a Notification on February 8, 2024, introducing the much awaited Amnesty Scheme 2024.

The scheme intends to give significant benefits to dealers and individuals by granting tax rebates and facilitating the resolution of outstanding demands and disputed amounts under the Goods and Services Tax Regime.

Key Provisions of the Amnesty Scheme 2024:

The scheme, officially known as the Amnesty Scheme 2024, is effective immediately and will last until July 31, 2024.

The scheme applies to all dealers or individuals with outstanding demands or disputed amounts under various Acts until June 30, 2017, excluding those relating to the Rajasthan Value Added Tax Act, 2003, and the Central Sales Tax Act, 1956, for goods specified in Entry 54 of the State List of the Seventh Schedule to the Constitution of India.

The scheme includes a structured table that details the circumstances and extent of the tax rebate, as well as the remission of interest, penalty, and late fees for various kinds of outstanding claims or disputed amounts.

To be eligible for amnesty benefits, applicants must electronically communicate their desire to the relevant Assessing Authority via the Commercial Taxes Department’s website. A separate notice is necessary for outstanding demands/ disputed amounts under various Acts and before separate Assessing Authorities.

Conditions include depositing the required money, giving an assurance to withdraw pending proceedings before any Court, Tax Board, or Appellate Authority, and prohibiting returns linked to tax rebates and/or waivers under this plan.

Cases involving installment payments under the Amnesty Scheme 2023 will continue to be handled in accordance with the prior scheme’s requirements.

For cases pending under the Amnesty Scheme 2023, willingness expressed under the previous system is considered appropriate to the Amnesty Scheme-2024, with the amount to be paid indicated again.

The Rajasthan GST Department’s Amnesty Scheme 2024 offers dealers and individuals a valuable opportunity to resolve outstanding claims and disputed amounts, resulting in considerable tax rebates and a smoother resolution process.

To take advantage of these benefits, eligible parties are encouraged to follow the indicated processes and meet the required conditions within the scheme’s operational time.
