High Court granted anticipatory bail to Chartered Accountant in fake surety case The Bombay high court recently granted pre-arrest bail to a city chartered accountant (CA) after he was booked for presenting a fraudulent guarantee. Behram Pardiwala (66), who was arrested on May 27 by D B Marg police station for cheating by personation, forgery, and misrepresenting as true a certificate known to be fraudulent, petitioned for the order, which was granted by Justice Surendra Tavade. According to his appeal, he has been practising for 36 years and has served high-net-worth clients and respected celebrities such as former Attorney General Soli Sorabjee and goldsmith Dinshah Gazdar and their families. Pardiwala was a co-testator in the will of a man. Following his death in December 2015, his brother filed a complaint alleging that the will was forged and manufactured. In March 2016, Pardiwala surrendered to Tardeo police, was arrested, and released on bail. It was discovered in 2018 that the man who stood surety for him had filed fake and bogus documents. When Pardiwala learned that Padwekar had been charged with a crime, he petitioned the court, who granted him monetary bail. According to Pardiwala's lawyers, Sujay Kantawala and Neha Ahuja, the FIR does not charge him with any crime. In his November 4 order, Justice Tavade stated that it was the duty of Pardiwala's attorney to check the document of surety, which he did and which was accepted after scrutiny. "As a result, it cannot be stated that the petitioner (Pardiwala) was concerned with the creation of his surety document." "Prima facie, no offence is made out against the petitioner," he ruled, ordering that if detained, Pardiwala be freed on a personal bond of Rs 15,000 with the condition that he appear at the police station whenever summoned.
