Recently, the Ministry of Corporate Affairs (MCA) has issued the Frequently Asked Questions (FAQs) on registration and compliance requirements for foreign companies and Indian subsidiaries of the foreign corporate bodies.
The FAQs answer a lot of important questions. These include registration of branch, liaison and project offices in India through Form FC-1 and changes and extensions relating to such offices through Form FC-2.
The MCA has also prescribed the requirement of annual filing through Form FC-3 and Form FC-4. The FAQs also give guidance on name reservation for Indian subsidiaries of foreign companies.
Another important point discussed is the treatment of foreign documents. The FAQs explain when documents need to be apostilled, notarized or consularized to be submitted in India.
The new FAQs are intended to help foreign companies and their Indian subsidiaries better understand the registration and filing requirements to enable smoother compliance with the relevant rules.
