Kerala High Court Extends Validity of all Interim Orders in Lieu of Fluctuating TPR till March 16, 2022
The Kerala High Court on Monday extended the duration of all interim decisions made by the High Court and all courts and tribunals coming under the High Court’s supervisory authority for another month, taking into account the variation in the state’s Test Positivity Rate.
During the Covid-19 rise in the State, a Full Bench of Chief Justice S. Manikumar, Justice Muhamed Mustaque, and Justice Shaji P. Chaly extended the validity of its prior order extending all interim orders till 21 February.
“We went over the Government Orders. Other learned counsel have not voiced a contrary opinion. Thus, taking into account the test positivity rate and the learned Advocate General’s proposal, the interim order dated January 18, 2022 in W.P. (C) No. 11316 of 2021 is prolonged until March 16, 2022.”
The High Court decided on January 18 to prolong the validity of its interim order dated May 19, 2021, in which it gave directions for the extension of interim orders.
This was done in light of the Supreme Court‘s directive to extend the time limit for filing cases under all general and special legislation in the country to February 28.
As a result, their validity period has been extended until March 16, 2022.
In open court, Advocate General K. Gopalakrishna Kurup, ASGI S.Manu, DGP T.A Shaji, President of the Kerala High Court Advocates’ Association Advocate Rajesh Vijayan, and President of the Kerala Federation of Women Lawyers Advocate P.K.Santhamma all expressed their opinions.
Despite the fact that the Kottakkal Co-operative Urban Bank Limited sought to be added as an additional respondent, Advocate Devaprasanth. P.J. representing the proposed additional respondent submitted that the Bank would follow the general order dated January 18, 2022, which had been extended until March 16, 2022.
As a result, no order was issued in this impleading application, and it was dismissed.
