MCA Notifies Key Provisions of IBC Amendment Act Effective from May 26, 2026
The Ministry of Corporate Affairs has recently issued a notification on May 22, 2026, regarding appointing May 26, 2026, as the date for certain provisions of the IBC Amendment Act.
The government has not implemented the whole amendment act in one go. Only certain provisions have been made effective as of May 26, 2026. The other provisions not referred to in the notification shall come into force on a date to be fixed by a separate notification.
The notification states that sections 2 to 6, 8 to 33, 35 to 39, 41, 43 to 44, 46, 48 to 59, 61 to 66, 68, and 72 of the Amendment Act have come into operation. In addition, certain specific clauses and sub-clauses of sections 34, 69, and 70 have also been notified.
The notification also specifically excludes sub-clause (xx) of clause (b) of section 70 from implementation for now.
