Netizen Shares GST Notice Demanding Excess ITC Despite Lower Claim in GSTR-3B vs GSTR-2A

A recent GST notice showed a clear mistake made by the tax department, creating unnecessary confusion among the taxpayers.

In a post shared on Platform X, a user attached the picture of the GST notice highlighting the GSTR-3B and GSTR-2A difference regarding ITC. In the communication, the department claimed that it found some discrepancies during the scrutiny of the GST return.

In the table showing the difference between the ITC claimed as per GSTR-3B and the ITC available as per GSTR-2A, the department wrongly mentioned the difference as “excess ITC availed.” The ITC available as per GSTR-2A was higher than the ITC claimed as per GSTR-3B, which means that the taxpayer still has some credit left. However, despite this, the department has asked the taxpayer to pay the difference as tax.

This mistake causes an unnecessary tax burden and panic among the taxpayers, even though the taxpayer is not at fault.
